There are times when conflict is minimal, but you recognize that the potential exists. Here you might want to use a mediator to facilitate a prevention-oriented meeting. For example, in cases of estate planning where a senior wants to review the distribution of assets prior to his demise, we may facilitate a family meeting to encourage clear and open communication, minimize surprises and thereby prevent squabbles in the future. Similarly, after the death of a parent, we may facilitate a family meeting amongst the adult children to talk through emerging differences and prevent things from escalating into serious conflict. Clients are encouraged to consult their attorney, and you may wish to include them in a meeting. However, our focus is on supporting family members to do most of the talking in their work to settle matters. This promotes greater "ownership" of the process, saves both time and money, preserves family ties, and results in greater satisfaction.
